PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 22 July 1998, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l4, AR 635-200, by reason of misconduct—abuse of illegal drugs, with a recommendation that you be retained on active duty. He was advised of his rights. The applicant consulted with legal counsel, was advised of the impact of the discharge action, requested consideration of his case by an administrative separation board and submitted a statement in his own behalf. The unit commander subsequently recommended that the applicant be retained in the United States Army. The intermediate commander reviewed the proposed discharge action and recommended approval of the applicant’s retention in the United States Army. On 28 July 1998, the senior intermediate commander recommended separation with issuance of a general, under honorable conditions discharge. On 18 September 1998, the applicant was notified to appear before a board of officers. On 5 November 1998, the board of officers met; applicant appeared with counsel. The Board recommended separation with issuance of a general, under honorable conditions discharge. On 4 December 1998, the separation authority approved the findings and recommendations of the board and directed that the applicant be discharged with a general, under honorable conditions discharge.

         b. On 31 January 1999, the applicant was discharged. At the time of discharge, the applicant had 1 year, 1 month, and 27 days service on his current enlistment under review and 7 years, 11 months and 24 days total time in service.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

 (2) The issue is accepted. The Board carefully examined the applicant’s record of service during the period of enlistment under review. Based on the evidence of record, the Board determined that the applicant’s discharge was inequitable. The Board concluded that the discrediting entry in the applicant's record was outweighed by prior or subsequent service of sufficient merit to warrant an upgrade of the discharge being reviewed. Further, the Board found that the preponderance of the applicant’s service attests to faithful and honorable service. Accordingly, the Board voted to grant relief in the form of an upgrade of characterization of service to fully honorable and to change the narrative reason for discharge to Secretarial Authority.
